United States President President Donald Trump has taken his legal battle over birthright citizenship to the U.S. Supreme Court, seeking to overturn nationwide injunctions that have blocked his executive order limiting automatic citizenship for children born on American soil.

Trump’s order, signed on January 20 upon his return to office, directs federal agencies to deny citizenship to U.S.-born children unless at least one parent is an American citizen or a lawful permanent resident. The order was set to take effect on February 19 but has been halted by federal judges in Washington, Massachusetts, and Maryland.

The Justice Department has now asked the Supreme Court to narrow or overturn these injunctions, arguing that the 14th Amendment’s citizenship clause does not apply to children of undocumented immigrants or those on temporary visas, such as students and foreign workers.

Legal challenges to the order have been swift, with Democratic state attorneys general, immigration advocates, and expectant mothers arguing that the move violates constitutional protections. The 14th Amendment explicitly states that all persons “born or naturalized in the United States, and subject to the jurisdiction thereof,” are U.S. citizens.

Trump’s effort to curb birthright citizenship is a key part of his broader immigration crackdown, which also includes military involvement in border security and an expanded asylum ban. With a 6-3 conservative majority on the Supreme Court, including three Trump-appointed justices, the case could have far-reaching implications for U.S. immigration policy.

The Supreme Court’s response to the administration’s request will determine whether Trump’s order can move forward or remains blocked by the lower courts.
